1. INTRODUCTION
These General Terms and Conditions of Sale and Legal Conditions apply to the products that we sell on this website. You acknowledge that a contract exists between you and Les Noies del Medi (hereinafter “Les Noies” or “we” or “us”) for the products purchased during the online ordering process by checking the corresponding box.
These General Terms and Conditions (GTC) shall apply from the date the purchase is made.
The contractual relationship of sale involves the delivery of a specific service in exchange for a determined price, which is publicly displayed on the website.
Territory of Application: Purchases of products are available worldwide.
Capacity to Contract: To place an order, the User must be of legal age and have the legal capacity to enter into a contract.
Customer Acceptance: Purchase validation through the website is carried out via email and also implies automatic acceptance of the GTC. These Terms and Conditions are available on the website or, upon request, can be provided to the User by email.
2.SCOPE OF SERVICES
We operate as an association that provides to our community the following services in our platform:
Surf Trips & Travel Experiences
We organize and promote surf-related trips and retreats, both nationally and internationally, by providing information, itineraries, and booking options for these experiences.
We also coordinate with third-party service providers (Providers) such as accommodation, transportation and surf or activity instructors.
Events & Community Activities
Les Noies hosts and manages events, workshops, and gatherings related to surf culture, wellness, and community building.
Frequently, we will offer registration and ticketing service for these activities through our website. Please note that the platform that provides the tickets and processes the payments is BBVA TPV DIGITAL which is independent of our association. By using their website, you are subject to their own terms and conditions.
Online Store
We can offer for sale branded merchandise, surf-related products, and other goods through the website’s e-commerce platform.
Membership & Community Engagement
We provide members with exclusive content, news, and updates about upcoming trips, events, and products through our social network and newsletter upon subscription. Les Noies can sometimes share articles, blog posts, photos and other material related to carried events.
Please note that while Les Noies makes every effort to deliver high-quality experiences and products, certain services (such as accommodations, transportation, and instruction during trips) may be provided by independent third parties, for which we cannot be held directly responsible.
All bookings made through our Site are subject to availability and the terms and conditions of the relevant service providers. In cases where we act solely as an agent, your contract will be directly with the service provider, and we shall not be liable for their acts, omissions, or performance.
3.PURCHASE PROCESS, PAYMENTS AND CANCELLATIONS
Please be informed that, in accordance with the requirements of Article 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce, the contracting process will follow the steps outlined below:
Purchase Process
- Add the product to the cart.
- View the cart.
- Click on “Checkout”.
- Enter contact information and billing address.
- Select payment method.
- Be redirected to BBVA’s digital payment gateway.
- Confirm the payment and receive a confirmation page.
To make a purchase, the User is not required to register. The data requested will be limited to those strictly necessary for billing and shipping, as specified in the Privacy Policy.
After completing the purchase on the website, the User will receive a confirmation email containing the purchase details and, when applicable, shipping information. If the User does not receive the confirmation email, they may contact info@lesnoiesdelmedi.com to report the issue.
The User will not receive any additional communications after the confirmation email unless they have expressly consented to receive commercial communications at the time of purchase. By completing a purchase, the User accepts these Terms and Conditions, which constitute a binding purchase agreement between the parties.
The payment method available is credit or debit card, and the transaction will be processed through BBVA’s DIGITAL POS system. The data required to process the payment are: full name, email address, phone number, card number, expiration date, and security code. The User’s data is protected through a security protocol used to encrypt the information provided.
All service prices displayed include the applicable VAT in effect at the time of purchase. All prices shown on the website are valid and expressed in Euros (€).
In the case of limited-time promotions, the promotional discount will only apply if the order is placed within the promotional period.
The data recorded via the selected payment method will serve as evidence of the date on which the financial transaction took place and will be used to determine whether the purchase qualifies for the promotion.
Delivery
Delivery will be made to the address provided by the User. The estimated delivery timeframe for any product or purchase is up to a maximum of two weeks. Shipping costs will be specified at the time of purchase.
Along with the order confirmation, the User will receive a tracking code to monitor the shipment.
Please note that once the order has been handed over to the shipping carrier, Les Noies del Medi is no longer responsible for the security of the package during transit.
Cancellation and Refund Policy
Cancellation and refund conditions vary depending on the type of service purchased:
- Classes: May be canceled up to 24 hours in advance, with a full refund of the amount paid.
- Events: Tickets are non-refundable and cannot be canceled. However, the User may resell their ticket through the same platform on which it was purchased, Shotgun.
- Trips: May be canceled up to two month in advance to receive a refund of the amount paid.
- Online store: If any of the products purchased from the online store are defective or if the customer simply changes their mind about the purchase, they will have 14 days to make an exchange or return, provided that the purchased items are in perfect condition and show no signs of use or wear
If any of the above conditions are met, the amount paid will be refunded. Refunds will be processed within a maximum of 14 calendar days from the date the cancellation or return is accepted and will be issued using the same payment method used for the original purchase.
4. INTELLECTUAL PROPERTY AND DATA PROTECTION
All content, materials, designs, logos, images, videos, and text available on this website are the property of Les Noies and are protected by copyright, trademark, and other intellectual property laws.
Users may not reproduce, distribute, modify, display, or create derivative works from any content on this website without prior written permission from us.
Any unauthorized use of the website’s intellectual property may result in legal action.

The Provider and the User agree to submit any dispute arising from the provision of the services covered by these Terms and Conditions to the courts and tribunals of the User’s place of residence, provided that the User is considered a consumer for the purposes of the Spanish General Law for the Defense of Consumers and Users.

5. LIABILITY DISCLAIMER
The User acknowledges that participation in the classes, events, and trips organized by Les Noies del Medi may involve physical activity, outdoor environments, and travel. By purchasing and/or participating, the User confirms that they are in suitable physical condition and voluntarily assumes any risks associated with the activity.
Les Noies del Medi maintains Civil Liability Insurance to cover damages arising from faults attributable to the organization. However, this insurance does not cover incidents derived from the personal condition, decisions, or actions of the User. Therefore, each participant is responsible for their own health, safety, and personal belongings during the activities.
Les Noies del Medi is not liable for injuries, personal accidents, loss of belongings, delays, or any other damages that may occur during the activities or during transportation to and from the activity locations. Once the service has been delivered or the participant has joined the event or trip, all responsibility for their personal well-being lies with the User.
In cases where third-party providers are involved (such as transportation, accommodation, or venue services), Les Noies del Medi acts solely as an intermediary and shall not be held responsible for failures, cancellations, or incidents attributable to such third parties.
Nothing in this Disclaimer limits any non-excludable consumer rights under applicable law.
